The first proposal for the EU Deforestation-free Regulation (EUDR) was passed by the EU Commission in 2022 and became active on 29th June 2023. However, the implementation by EU member states shall apply starting from 30th December 2024. Micro and small enterprises will instead enjoy a longer adaptation period, as they will have time until June 2025 to prepare for the requirements.

The policy should be reviewed by the end of June 2028 and then every five years to identify any issues or potential improvements. The review will focus on tools to further facilitate international trade, on the repercussions of EUDR on smallholders and local people, on changes to the scope and requirements based on their effectiveness, on the quality of monitoring, and on the new possible interpretations of the concept of “forest degradation”, along with other minor aspects.

What about the EU Timber Regulation (EUTR)?

The EU Timber Regulation (EUTR), precursor of the EUDR, came into force 11 years ago on 3rd March 2013 and will be repealed by EUDR from 30st December 2027.

In the case of timber and timber products affected both by EUTR and EUDR, the Regulation makes a distinction based on the time of harvest. If the products are made from wood that was harvested before 29th Jun 2023 and will enter the EU market before 30th Dec 2027, they can continue adhering to EUTR requirements until 30th December 2027. If such products are made from wood that was harvested after 29th June 2023, they must comply with EUDR requirements from 30th December 2024.

Obviously, wood products that were not affected by EUTR, but will be affected by EUDR following the extension of the Regulation impact on a larger range of timber products, must adhere to EUDR from 30th December 2024, without exceptions.
